AFFIRMATIVE ASYLUM
Affirmative Asylum is a legal process that allows individuals who are already in the United States to apply for protection because they fear persecution in their home country due to race, religion, nationality, political opinion, or membership in a particular social group.
This process is handled by U.S. Citizenship and Immigration Services (USCIS) and must be initiated voluntarily by the applicant within one year of arrival in the U.S., unless they qualify for an exception.
Who Can Apply for Affirmative Asylum?
To be eligible for Affirmative Asylum, you must:
✅ Be physically present in the U.S. when submitting the application.
✅ File Form I-589 (Application for Asylum and for Withholding of Removal) with USCIS.
✅ Prove a credible fear of persecution if returned to your home country.
✅ Not have participated in the persecution of others.
If approved, asylum provides the right to live and work legally in the U.S., apply for a Green Card after one year, and eventually apply for U.S. citizenship.
The asylum process is complex and requires strong evidence and legal preparation to increase the chances of success.
